1. Agreement to Terms

By accessing or using TrackMyBooking (the "Service"), operated by ND Innovations LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

TrackMyBooking is a hotel price tracking service that monitors hotel prices across various booking platforms and notifies users of price changes. The Service includes:

  • Hotel price monitoring and tracking
  • Price drop alerts via email
  • Historical price data visualization
  • User account management

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers
  • Transmit any viruses, worms, or malicious code
  • Use automated systems or software to extract data (scraping)

  • Transactions completed on third-party platforms

  • Any disputes between you and third parties

8. Disclaimers

8.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8.2 Price Accuracy

While we strive to provide accurate price information, we cannot guarantee the accuracy of hotel prices displayed. Always verify prices directly with the booking platform before making a reservation.

8.3 No Travel Advice

The Service is for informational purposes only and does not constitute travel advice. We are not responsible for any travel decisions made based on information from the Service.

9. Limitation of Liability

To the maximum extent permitted by law, ND Innovations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or use
  • Missed savings opportunities
  • Travel booking errors or cancellations
  • Any damages arising from your use of the Service

In no event shall our total liability exceed the amount paid by you to use the Service in the past twelve (12) months, or $100 if no payments were made.

10. Indemnification

You agree to defend, indemnify, and hold harmless ND Innovations LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12. Changes to Terms

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in California.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@trackmybooking.com.

14.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), except where prohibited by law. The arbitration shall be conducted in California.

14.3 Class Action Waiver

You agree to resolve disputes only on an individual basis and not as part of any class action or representative proceeding.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ND Innovations LLC regarding the use of the Service, superseding any prior agreements.
